Pharmacy Law Lowdown: GLP-1 Compounding

This episode highlights the FDA’s announcement regarding GLP-1 supply stabilization and critical compliance strategies for 503A pharmacies.

In episode 8 of the Pharmacy Law Lowdown, hosts Dae Lee, PharmD, Esq, CPBS, and Lucas Morgan, Esq, shareholders at Buchanan Ingersoll & Rooney, analyze the FDA’s April 1, 2026, announcement regarding clarified compounding policies as national drug supplies begin to stabilize.

This statement restates existing guidelines for 503A pharmacies, which may only compound medications for individual patients pursuant to a valid prescription. A central focus of the guidance is the restriction against producing inordinate amounts of medications that are essentially copies of commercially available products.

The FDA defines a copy as a drug sharing the same active ingredient, route of administration, and a strength within 10% of the commercial version. FDA clarifies that adding secondary ingredients like Vitamin B12 does not necessarily exempt a formulation from this classification.

Although the agency established a general enforcement threshold for pharmacies filling 4 or fewer prescriptions of a specific formulation per month, providers must prioritize medical necessity. Documentation remains the primary defense during unannounced state board inspections, which evaluate whether a compounded product fills a specific patient gap.

Beyond records, pharmacies must adhere to USP standards and maintain necessary state-specific sterile compounding permits. Standardizing these procedures allows pharmacies to maintain compliance while providing essential tailored care.
