Franchisee doesn't owe future profits from defunct pharmacy

A franchisee who closed his unprofitable Missouri pharmacy does not owe Medicine Shoppe future profits, according to an arbiter's ruling. Medicine Shoppe had sued Alan Weissman, Pharm.D., for $308,000 after he shuttered his pharmacy in Chesterfield 11 years into a 20-year license agreement, which gave Medicine Shoppe 5.5% of the pharmacy's gross revenues. The arbiter ruled in favor of Weissman but ordered both sides to pay their own attorney fees and costs.
